Significant changes take effect regarding private sector IR35 legislation from April 2020 which may have a serious impact on your business.
In very simple terms, the legal responsibility for determining whether a Contractor is deemed “inside” or “outside” IR35 will move from the Contractor to YOU directly.
In summary:
From April 2020, the obligation to assess employment status for tax will move to you the hirer.
You will be expected to exercise “reasonable care” when making those assessments, and if you fail to do so, you will assume the risk for unpaid Income Tax and National Insurance along with the reputational risk of non-compliance.
There is a reportedly low level of IR35 understanding of proposed changes in the Private Sector. Furthermore, there is little guidance on what HMRC expects from hirers for them to meet the “reasonable care” test with interpretation being largely left to you.
Many hiring companies do not have a good enough understanding of the employment or tax status of their existing flexible workforce and therefore do not fully understand the size of the change programme that must be implemented before April 2020 when legislation is enforceable.
